Depending on the employer, an employee may have certain rights to challenge proposed and effectuated disciplinary actions, including those based on performance or conduct. These rights may be derived constitutionally, be based on a policy or statue, or from an employee handbook. The processes and strategies for addressing the disciplinary action will vary depending on the type of employer and recourse available. This CLE will provide an overview of the available rights, and strategies for addressing, disciplinary actions issued to public and private employees.
